Attorneys must obtain certification to handle death penalty cases in South Carolina. Under Rule 421 of the South Carolina Appellate Court Rules (SCACR) there are two classes of attorneys certified to handle death penalty cases: lead counsel and second counsel. To obtain certification, attorneys must meet the requirements set forth in this rule. A link to the rule appears below.
